Your continued use of our platform means you accept these terms. We update them occasionally to reflect changes in our programs or legal requirements. When we make significant changes, we'll post a notice on our homepage for at least two weeks.

If you don't agree with any modifications, you should stop using our services. The date at the top of this document shows when we last revised these terms.

2. Educational Services Description

Optimflow Elite provides educational content and training programs focused on AR/VR game development for cross-platform applications. Our courses typically run between six and twelve months, with start dates scheduled for autumn 2025 and early 2026.

What We Offer

• Structured learning programs in AR/VR game development
• Access to educational materials, tutorials, and project files
• Guidance from experienced instructors with industry background
• Community forums for peer interaction and learning support
• Portfolio development assistance for completed projects

What We Don't Promise

We don't guarantee employment after course completion. Job market conditions vary, and individual outcomes depend on many factors beyond our control—your effort, prior experience, local job market, and how you apply what you learn all play a role.

Similarly, we can't promise specific income levels or project success rates. Game development is competitive, and results vary widely based on individual circumstances.

3. Enrollment and Access

Eligibility Requirements

You must be at least 18 years old to enroll in our programs. If you're younger, you need written consent from a parent or guardian. You'll also need basic computer literacy and the technical requirements listed in your specific program description.

Account Responsibilities

When you create an account, you're responsible for maintaining the security of your login credentials. Don't share your account with others. If you notice any unauthorized access, contact us immediately at contact@optimflowelite.com.

4. Payment and Refund Policy

Payment Terms

Course fees are listed in EUR and must be paid according to the schedule provided during enrollment. We accept various payment methods, which are shown during checkout. Prices include VAT where applicable under Albanian tax law.

Refund Conditions

You can request a full refund within 14 days of enrollment if you haven't accessed more than 15% of the course materials. After this period, refunds are calculated on a prorated basis, minus a 20% administrative fee.

We don't provide refunds after you've completed 60% of a program or if you've received a certificate of completion for any module.

Late Payments

If you're on a payment plan and miss a scheduled payment, we'll send a reminder. After 15 days without payment, we may suspend access to course materials until your account is current. We'd rather work with you than suspend access, so contact us if you're having difficulty meeting payment obligations.

5. Intellectual Property Rights

Our Content

All course materials, videos, documentation, code samples, and other content we provide remain our property. You get a limited, non-exclusive license to use these materials for your personal learning during and after your enrollment.

You can't resell, redistribute, or republish our materials. This includes posting course videos on YouTube, sharing project files on public repositories, or creating derivative courses based on our content.

Your Work

Projects you create during courses belong to you. You keep full rights to your original work. However, by submitting projects for review or showcasing them in our student gallery, you grant us permission to display them as examples of student work in marketing materials.

If you use this content for commercial purposes later, that's fine—just remember to remove any Optimflow Elite branding or logos from your final products.

Third-Party Tools and Software

Some courses require third-party software like Unity, Unreal Engine, or various development tools. These have their own licensing terms that you must follow. We provide guidance on which licenses you need, but you're responsible for obtaining and maintaining them.

6. User Conduct and Prohibited Activities

We've built a community of learners who support each other. To keep this environment productive, certain behaviors aren't acceptable:

• Harassment, discrimination, or threatening behavior toward other students or instructors
• Sharing course materials outside our platform or with non-enrolled individuals
• Attempting to access other students' accounts or private project files
• Using our platform to distribute malware or engage in phishing
• Posting spam, advertisements, or off-topic content in community forums
• Submitting plagiarized work or claiming others' projects as your own
• Reverse engineering or attempting to copy our platform's code

Violations can result in warnings, temporary suspension, or permanent removal from our platform, depending on severity. We handle each situation individually, but serious violations like harassment or content theft typically result in immediate termination without refund.

7. Privacy and Data Protection

We collect and process personal information to provide our educational services. This includes your name, email, payment details, learning progress, and project submissions. Our detailed Privacy Policy explains exactly what we collect and how we use it.

Data Security

We use industry-standard security measures to protect your information. This includes encrypted connections, secure payment processing, and regular security audits. However, no system is completely secure, and we can't guarantee absolute protection against all potential security breaches.

Your Data Rights

You can request access to your personal data, ask for corrections, or request deletion of your account. Contact us at contact@optimflowelite.com with data-related requests. We'll respond within 30 days and complete most requests within 60 days.

8. Disclaimers and Limitations

Educational Nature

Our courses provide education and training, not guaranteed outcomes. The game development industry is competitive and constantly changing. While we teach current best practices and relevant technologies, we can't control how the industry evolves or how employers evaluate candidates.

Technical Availability

We strive for 99% platform uptime, but technical issues happen. Scheduled maintenance, unexpected server problems, or third-party service disruptions may temporarily prevent access. We're not liable for lost learning time due to technical issues, but we'll extend deadlines when significant outages occur.

Content Accuracy

We work hard to keep course content current and accurate, but game development technologies change rapidly. Some information may become outdated between course updates. We update major courses annually and patch critical changes as needed.

9. Limitation of Liability

To the maximum extent permitted by Albanian law, Optimflow Elite's liability is limited to the amount you paid for the specific course or service in question.

We're not liable for indirect, incidental, consequential, or punitive damages. This includes lost profits, lost opportunities, data loss, or business interruption, even if we've been advised such damages might occur.

Specific Exclusions

We're not responsible for outcomes beyond our direct control, including but not limited to:

• Employment outcomes or job placement results after course completion
• Financial success of games or projects you develop using skills learned here
• Compatibility issues with third-party software or hardware you use
• Changes in industry standards or technology that affect course relevance
• Actions or omissions of other students in collaborative projects

10. Termination

Your Right to Terminate

You can cancel your enrollment at any time by contacting us. Refunds, if applicable, will follow the policy outlined in Section 4. After cancellation, you'll lose access to course materials within 7 days, so download any projects or notes you want to keep.

Our Right to Terminate

We can terminate your access for violations of these terms, non-payment, or fraudulent activity. In most cases, we'll warn you first and give you a chance to fix the issue. Immediate termination without warning is reserved for serious violations like harassment or content theft.

If we terminate for cause, you won't receive a refund. If we discontinue a program you've enrolled in, we'll either provide a comparable alternative or refund the prorated value of unused content.

11. Governing Law and Disputes

These terms are governed by Albanian law. Any disputes will be handled in the courts of Tirana, Albania.

Dispute Resolution Process

1. Contact us directly at contact@optimflowelite.com to discuss the issue
2. If we can't resolve it informally within 30 days, either party may request mediation
3. Mediation will be conducted in English by a neutral mediator in Tirana
4. If mediation fails, either party may pursue legal action in Albanian courts

This process doesn't prevent you from seeking emergency relief if necessary, such as injunctions to prevent irreparable harm.

12. General Provisions

Entire Agreement

These terms, along with our Privacy Policy and any specific program agreements, constitute the entire agreement between you and Optimflow Elite regarding your use of our services.

Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full effect. We'll replace unenforceable provisions with valid ones that most closely match the original intent.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right. We might choose not to enforce something in one instance without giving up our right to enforce it later.

Assignment

You can't transfer your rights or obligations under these terms to anyone else. We can assign our rights and obligations to another entity, such as if we're acquired or merge with another company, as long as your rights remain protected.

Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control—natural disasters, wars, pandemics, government actions, or significant infrastructure failures. We'll notify you of such situations and work to resume services as quickly as possible.
